General Terms and Conditions (“T&C”) for Online Sports Betting of ODDSET Sportwetten GmbH

A. General information
I. Betting operator
1. ODDSET GmbH with its registered office at Konrad-Zuse-Platz 12 in 81829 Munich, Germany, commercial register number HRB 196232, is a licensed gambling provider with licence number RPDA Dez. III 34-73 c 38.01/3-2016/12, and operator of ODDSET sports betting (hereinafter also referred to as “sports betting" or “sports betting offers").
2. The terms used in these General Terms and Conditions apply equally to the male/female/diverse form and are not used to the detriment of either gender.
II. Binding nature of the T&C
- For participation in the online sports betting offer of ODDSET via desktop and mobile applications (incl. the app) and all contracts concluded with the ODDSET sports betting Customer (hereinafter referred to as the “Customer" or “Bettor”) via the internet or mobile internet applications/apps (together referred to as “internet offers”), these T&C, including any supplementary terms (e.g. for special promotions), in the respective version valid at the time of conclusion of the bet or agreement shall be authoritative exclusively.
- The Customer accepts these T&C in the currently valid version, including any supplementary terms (e.g. for special promotions), as binding, for the first time upon registration, with each transaction in the player account, but at the latest when placing a bet.
- The T&C can be viewed in the internet offers and can be printed out via oddset.de. This also applies to any modifications of and amendments to the T&C as well as to any supplementary terms. ODDSET GmbH reserves the right to use a different form of notification.
- These T&C take precedence should they differ from information provided in other media and other advertising statements and in the special terms and conditions of offers.
- ODDSET GmbH reserves the right to make amendments to these T&C at any time. In the event of an amendment, the Customer will be notified of the new terms and conditions by email, to the email address provided to ODDSET GmbH upon registration. Any amendments shall come into force six (6) weeks after the notification has been sent. Within this period, the Customer can object to an amendment, explicitly and in text form. If the Customer does not object and continues to use the offers after the expiry of the deadline, they accept the amended terms and conditions as binding. In the aforementioned notification by email, the Customer will specifically be made aware of this consequence of their conduct. Should the Customer object to an amendment prior to expiry of the deadline, further use of the services will not be possible. The Customer is responsible for obtaining information about the respective valid terms and conditions before concluding a betting contract or placing a bet.
- ODDSET GmbH may waive rights under these T&C in individual cases. The Customer has no claim to a waiver of such rights in the future.
III. Object of ODDSET sports betting
- The object of ODDSET sports betting are bets at fixed odds on the outcome of sporting events or parts of sporting events (“result bets”) as well as on individual occurrences during the sporting event or on a combination of such occurrences (“event bets”) (together referred to as “betting events"). Bets that can be placed before the start of the sports event to which the bet relates are so-called pre-match bets, whereas bets placed during the ongoing sports event are so-called live bets.
- All odds lists are displayed in the ODDSET GmbH internet offers.
- Within the framework of an ODDSET sports bet, the Customer can place tips ("predictions") on a betting event ("single bet") or a combination of several betting events ("combination bet"). A system (also called “system bet”) is a special form of combination bet where the Customer combines a subset of the tips and plays several combination bets. The types of bets offered and their structure are specified by ODDSET GmbH in the betting programme. The content and execution of the individual types of bets are further specified in these T&C and in the Betting Rules.
IV. Betting confidentiality
ODDSET GmbH maintains betting confidentiality. In particular, the Customer’s name may only be disclosed with the Customer’s expressed consent. ODDSET GmbH’s statutory obligations to disclose information remain unaffected by this.
B. Betting contract and player account
I. Betting contract
A Customer can participate in ODDSET sports betting by submitting an offer to conclude a betting contract via the ODDSET GmbH internet offers. The betting contract is then concluded between the Customer and ODDSET GmbH in accordance with the provisions of these T&C.
Payment transactions are made via the player account to be set up for each Customer.
II. Requirements for participation in betting, registration, provisional account and deposits
- Participation in the ODDSET GmbH internet offers requires a player account to be set up. This account is only available to persons resident in Germany.
- To set up the player account, the Customer must provide the following data during the registration process: first name, last name, name at birth, date of birth, place of birth and place of residence. The information provided by the Customer will be verified for accuracy by ODDSET GmbH. Until complete identification and verification of the Customer data provided, participation in the games is only possible within the framework of the provisional account (see part B. II. no. 17).
- The minimum age for registration and use of the ODDSET GmbH internet offers is 18 years. Participation in betting by minors (persons under 18 years of age) or blocked players (see part B. IX. no. 5, X.) is prohibited by law. The exclusion of minors and blocked customers is ensured by identification and authentication.
- ODDSET GmbH is obligated to verify the data provided (in particular the age of majority). The Customer must confirm or, if necessary, change their details in each case at the latest after the expiry of one year since the last complete verification; ODDSET GmbH is obligated to verify the confirmation or the change of data. The Customer is obligated to provide suitable proof and documents upon request. ODDSET GmbH also uses the following verification services, among others, to verify the Customer data provided: SCHUFA via GBGroup, SOFORT, IDnow. For this purpose, Customer data is processed by the respective service provider. ODDSET GmbH reserves the right to verify all information provided by the Customer, including information regarding their solvency, at any time if necessary. ODDSET GmbH informs the Customer of this retrieval of information – in accordance with the provisions of the German Telemedia Act (TMG), the German Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (GDPR) – during the registration and identification process by reference to the ODDSET GmbH Privacy Policy.
- The Customer is obligated to set an individual monthly deposit limit. As a matter of principle, this limit may not exceed EUR 1,000. Due to legal requirements, ODDSET GmbH is obligated to transmit the chosen monthly deposit limit to the nationwide gambling analysis system LUGAS ("LUGAS"). During registration or prior to the first deposit, the Customer is obligated to set a customer-specific, cross-provider deposit limit, unless such a limit has already been notified to LUGAS (limit file). In order to collect the aforementioned data ODDSET GmbH is legally obligated to operate a so-called safe server. The evaluation system operated by the responsible supervisory authority, the Joint Gambling Authority of the Federal States, regularly accesses this safe server and downloads the stored data for processing. - The Customer can request to increase the monthly deposit limit. The Customer does not have a legal claim to the requested limit increase. In order to process the request for a limit increase, ODDSET GmbH is obligated either to carry out background checks (for instance via SCHUFA) or to request corresponding meaningful documents from the Customer as proof of the Customer's economic capacity. Details will be provided to the Customer when the request is being processed. Further information in this context is available in the ODDSET GmbH Privacy Policy.
- ODDSET GmbH’s managers, directors, employees, consultants and representatives as well as ODDSET GmbH’s suppliers and service providers may neither open a player account with ODDSET GmbH nor participate directly or indirectly in the ODDSET GmbH offers.
- Persons who have a direct or indirect influence on the outcome of a sporting event (for instance participating sportspersons, athletes, officials), as well as third parties commissioned by such persons, are excluded from participating in betting on the corresponding betting events.
- The Customer must place bets as an individual. Organised betting and betting syndicates are excluded from participation. Should ODDSET GmbH assume that organised betting or a betting syndicate exists, the respective betting transactions may be cancelled.
- It is prohibited to gain an advantage by colluding or connecting with other betting customers or using other unfair methods. If abnormalities are detected, for example because the same bet has been placed more than once or with unusually high stakes within a short period by one or more customers, the betting transaction may be cancelled.
- Betting on behalf of bookmakers and betting brokers is not permitted.
- If the Customer provides false information during the registration process or during the annual verification of data, ODDSET GmbH may close the Customer's player account and thus terminate the contractual relationship.
- The Customer confirms upon registration that they are acting in their own name and for their own account, i.e. that they are the beneficial owner within the meaning of the Money Laundering Act (Geldwäschegesetz, GwG). If the Customer is not the beneficial owner, no player account can be opened, and no valid betting contracts are concluded.
- The Customer will also be cross-checked against the politically exposed person-list ("PEP") and sanctions lists by an external service provider in order to verify whether they hold or have been entrusted with a high public office. The continuation of the business relationship with a politically exposed person is subject to approval by the ODDSET GmbH management. - Each Customer may only have one player account. As access parameters for betting participation, the Customer enters an email address and a secure password chosen during registration. The password must consist of upper- and lower-case letters as well as at least one number and at least one special character and must have a minimum length of 8 characters. The password can be changed as required. ODDSET GmbH shall under no circumstances be held liable for any losses incurred by the Customer as a result of unauthorised or improper use of your login information for which the Customer is responsible.
- ODDSET GmbH may refuse registration without giving reasons. A registered Customer may request the closure of the player account from ODDSET GmbH at any time without giving reasons. Subsequently, the credit balance on the player account is paid out to the Customer and the account is closed.
- ODDSET GmbH may also notify the Customer at any time without giving reasons that it will close the player account. Subsequently, the credit balance on the player account is paid out to the Customer and the account is closed.
- In the event of a breach of these provisions, ODDSET GmbH reserves the right to refuse to pay out any winnings and the stakes already deposited, and to cancel the bets. ODDSET GmbH assumes no responsibility whatsoever for having knowledge of whether the Customer is part of one of the aforementioned groups not entitled to participate. This means that ODDSET GmbH is entitled to take these measures at any time after it has become known that the Customer is part of one of the aforementioned groups.
- The provisions on pay-outs in the event of account blocking due to gambling addiction (B. X. no. 4) and the rules on the provisional account (B. II. no. 17) remain unaffected. Deposits made by the Customer and participation in further betting are blocked from the time of the notification that the account has been closed.
- During registration, all data must be filled in correctly and completely. In the event of incorrect data being provided, ODDSET GmbH may close the player account and withdraw from any existing betting contracts, or contest them on account of deception/error and cancel all winnings accrued.
- Betting is only possible after registration, including successful identification and successful payment of funds into the player account. By way of derogation, bets may be placed with a deposit limit of up to EUR 100 prior to the completion of identification using a provisional account during the 72-hour period after initial registration until full personal identification has been completed. No withdrawals from the provisional player account are possible until full identification and verification has been carried out. If the identification is not completed within 72 hours, further deposits and the placing of bets will be blocked. In addition, the player account will be deactivated or blocked.
- Registration and authentication for betting participation are carried out with the email address and the password chosen during registration. ODDSET GmbH reserves the right to change the authentication procedure.
- The Customer will be informed of the detailed procedure of their betting participation via the ODDSET GmbH internet offers.
- There must be sufficient funds in the Customer's account before the bet is placed. If the total stakes on the online bet slip are higher than the balance in the account, the Customer cannot place the bet. ODDSET GmbH may instead propose new stakes up to the amount of the current account balance. The Customer can place the bet with the stakes in this amount.
- If the balance on the account is not sufficient for full cover and the difference is not credited in time, offers to place bets will only be accepted by ODDSET GmbH in the order in which they are received, provided the account contains sufficient funds for each individual bet. If there are insufficient funds in the player account, no bets can be placed. It is not possible and inadmissible to “inject” additional funds for bets that have already been placed.
- If the stakes for a bet are only partially covered by the balance on the account, the bet is deemed to have been placed with stakes equal to the remaining balance on the account.
- ODDSET GmbH reserves the right to declare a bet void, including, but not limited to, a bet that is erroneously accepted even though the balance in the player account is insufficient to cover the stakes for a bet placed before the event.
III. Betting
- Betting is only possible after the Customer has logged into the player account.
- In the course of placing bets, ODDSET GmbH is legally obligated to transmit the Customer's activity to LUGAS (activity file). If the Customer is already registered in the LUGAS activity file as “active” with another betting operator, it is not possible to place a bet. In order to collect the aforementioned data, ODDSET GmbH is legally obligated to operate a so-called safe server. The evaluation system operated by the responsible supervisory authority, the Joint Gambling Authority of the Federal States, regularly accesses this safe server and downloads the stored data for processing. - By submitting the betting order, the Customer declares that they have no knowledge of the course or outcome of the respective sporting event or betting event.
- The placing of the bet itself is done in two steps:
In a first step, the Customer selects the bets by clicking on them from the betting programme. When the bets have been selected, they automatically appear in the online bet slip.
If the selection is correct, the Customer can click a confirmation button and is then referred to the second step.
In the event of incorrect entries, the Customer will be asked to correct them. Only after a correct selection of the bets will the Customer have the option of proceeding to the second step by clicking the confirmation button.
In a second step, the Customer can either go back to the first step and change the selection, or confirm and place the bet by clicking the "Bet now" button.
The Customer can select the amount of the stakes in the first step, or make or change this selection during confirmation in the second step.
- Before placing a binding bet, the Customer may correct or delete the predictions selected electronically.
- The Customer can optionally select that the betting order is forwarded to ODDSET GmbH immediately after submission, without requesting any further confirmation.
- After final confirmation by the Customer, a revocation of their offer to conclude a betting contract or a withdrawal from the betting contract pursuant to section 312 g (2) no. 12 of the Civil Code (BGB) is not possible anymore.
- For the conclusion of system bets, the Customer may only use abbreviated notations approved by ODDSET GmbH and used by ODDSET GmbH in the betting instructions or in supplementary notes.
- Bets/stakes will be processed according to the order in which they are received. This may lead to the acceptance and simultaneous rejection of different bets within one betting order.
- The Customer is solely responsible for the selection of the bets, the types of bets and the amount of the stakes.
- The Customer can bet on betting events as a single, combination and/or system bet (multiple bets).
- Multiple bets will not be accepted if the outcome of one part of the bet affects the outcome of another bet.
- ODDSET GmbH may allow the Customer to additionally select a "bank" or several "banks" for system bets. A “bank” is a tip that is included in all bets and must occur in order to win.
- With the placing of the bet, an offer to contract is submitted by the Customer. The conclusion of the betting contract is regulated in B.VIII.
- The Betting Rules apply in addition to these T&C. The Customer confirms to be aware of them.
- ODDSET GmbH reserves the right to mark the betting result with numbers, symbols and abbreviations (such as 1, X, 2). Any further information listed in the event or betting views form part of the Betting Rules for the relevant event and shall take precedence over these T&C in the event of any discrepancies.
IV. Bonuses
ODDSET GmbH can offer the Customer bonuses and promotions. The respective requirements and conditions can be found in the General and Specific Terms and Conditions for Bonuses and Promotions.
V. Stakes, maximum limits
- The Customer determines the betting stakes per bet within the framework of the options specified by ODDSET GmbH in the internet offers, with the exception of the restrictions set by possible stake limits, if any. The total stakes are determined by the type of game selected (single bet, combination bet, system bet) and can be a multiple of the stakes per bet.
- ODDSET GmbH reserves the right to unilaterally reduce the minimum stakes at any time or, subject to approval by the supervisory authorities, to unilaterally increase it.
- The Customer shall pay the total stakes upon submission of the declaration of their intention to participate in the bet.
- ODDSET GmbH reserves the right to set special winnings limits for individual players.
VI. Acceptance of bets, changes, blocking and cancellations
- ODDSET GmbH determines the closing time for each betting event included in the betting programme. The closing time for a betting order shall in each case be the closing time set for the betting event which takes place first within the betting order selected by the Customer.
- Bets where
‐ the closing time for an included betting event,
‐ the maximum stakes on a bet,
‐ the maximum achievable winnings of a bet,
or another limit is exceeded,
‐ the submitted tip, combinations of tips, an individual betting event or a result of a betting event or a prediction possibility have been blocked by ODDSET GmbH, or
‐ the bet placed contains a cancelled sporting event or a betting event that is not currently offered,
will be rejected. If the bet is nevertheless accepted, ODDSET GmbH is entitled to withdraw from the betting contract.
- All bets must be placed and accepted before the start of the event in question.
- Bets that have been placed and accepted in good time – except in the cases specified in these T&C or in the Betting Rules – cannot be cancelled or changed. It is therefore the sole responsibility of the Customer to ensure that all details of their bets are correct.
- Bets placed or received after the start of the relevant event will be deemed void, except where the betting offer allows a bet to be placed after the start of the relevant event (for example, live betting or outright/overall winner betting).
- If, at the time of accepting bets, information becomes known by which the outcome of the bet can be determined, ODDSET GmbH reserves the right to re-set the time limit for accepting bets or to declare the bet invalid and valued as "won" at odds of 1.00.
- ODDSET GmbH reserves the right to change, correct and update the fixed odds, the respective closing time of a betting event and the betting programme, as well as to block betting events, combinations of betting events and individual betting outcomes. This shall not affect the betting contracts already concluded, taking into account the rules for the valuation of bets.
Furthermore, ODDSET GmbH reserves the right, in the event of obvious errors in the betting programme, in particular errors occurring during the entry of betting odds and/or the valuation of a betting event (for instance mistakes in the specification of odds or results, teams), to correct such errors even retrospectively, or to declare the bets concerned invalid.
- ODDSET GmbH also reserves the right to subsequently cancel bets if the bet was won by the Customer due to a technical error and ODDSET GmbH proves the error(s) by means of technical records. The burden of proof for the existence of a technical error lies with ODDSET GmbH. The bets/stakes are credited back to the player account. ODDSET GmbH reserves the right to hold Customers who knowingly benefit from technical or administrative errors in the execution or receipt of payments liable for all resulting losses incurred by ODDSET GmbH.
VII. Confirmation of the betting order
- After the betting order has been submitted and the complete data has been transferred to the ODDSET GmbH sports betting system, a bet slip ID is assigned by the sports betting system when all data is saved. The bet slip ID is used to allocate the betting order to the data stored in the sports betting system.
- The Customer will be informed of the finalisation of this process – without prejudice to the provision in B. VIII. nos. 2 and 4 – through a notification in the player account. The betting order confirmation includes information on:
‐ date and time of acceptance of the bet
‐ per tip, the game/betting event, the selected type of bet, the predicted result, the odds
‐ the selected type of game (single, combination or system bet)
‐ the possible net winnings for single and combination bets
‐ the stakes paid
‐ the bet slip ID.
VIII. Conclusion and content of the betting contract
- The betting contract is concluded between ODDSET GmbH and the Customer if ODDSET GmbH accepts the offer to conclude a betting contract submitted by the Customer, in accordance with the following paragraphs.
- The Customer waives receipt of the declaration that their contract offer has been accepted by ODDSET GmbH. An overview of all bets placed by the Customer is shown in the "My bets" section of the website.
- The Customer confirms to be acting in their own name and for their own account.
- The betting contract is concluded when ODDSET GmbH has confirmed the conclusion of the bet. A bet is confirmed when it is displayed in the player account under "My bets". In individual cases, delays may occur. However, if the time when the bet was placed is disputed, the time when the bet was received by ODDSET GmbH in the sports betting system shall be relevant. If, for any reason, the Customer does not receive a confirmation message, the bet is still confirmed when it is displayed in the player account under "My bets". In all cases, ODDSET GmbH assumes that, when placing a bet, the Customer accepts the T&C, the Betting Rules, as well as any applicable terms and conditions for bonuses and promotions.
- As soon as a bet has been placed and accepted, the corresponding amount will be debited from the player account. Bets that have been accepted cannot subsequently be changed or reversed.
- The content of the betting contract shall be determined exclusively by the data recorded on the secure storage medium secured by digital or physical locking.
- In deviation from this, the Betting Rules for each type of sport shall additionally be taken into account for the content of the betting contract.
- The Customer waives receipt of the declaration that their offer to conclude the betting contract has been rejected by ODDSET GmbH or that ODDSET GmbH has withdrawn from the betting contract.
- ODDSET GmbH reserves the right to refuse to accept a bet without giving reasons and to declare unclear bets invalid.
- Furthermore, the withdrawal from the betting contract on the part of ODDSET GmbH can be declared for important reasons. An important reason exists, among other things, if:
- If ODDSET GmbH suspects any kind of event manipulation, it has the right, at its sole discretion:
‐ there are factual indications of the existence of a prosecutable criminal offence,
‐ a breach of a participation ban (B. III.) would occur or has occurred, or
‐ the Customer has provided false information during registration.
‐ to suspend the offer of an event or series of events in any of its markets; and
‐ to delay and/or withhold payment in respect of any event or series of events in any of its markets until the integrity of the event or series of events has been confirmed by the relevant sports association.
If it is confirmed by the relevant sports regulatory bodies that active manipulation of an event or series of events has taken place, ODDSET GmbH shall furthermore have the right, together with the relevant sports regulatory bodies, at its sole discretion, to suspend bets placed on such events that originate either from a person identified as possessing inside knowledge or information, or from any other person who, in ODDSET GmbH’s reasonable opinion, is connected to, acting in collusion with or involved in any way with such a person.
- In the event of a suspicion of betting fraud or the manipulation of games, ODDSET GmbH is entitled to forward the data stored (including information on the bets related to the suspicions) to sports associations, authorities or other third parties involved in the investigation of such suspicions.
- In the event of a breach of these T&C, ODDSET GmbH may furthermore exclude the respective Customer from participating in betting and may withdraw from contracts already concluded.
- The Customer will be informed of the rejection of an offer to conclude a betting contract or the withdrawal from the betting contract by ODDSET GmbH – without prejudice to the waiver of receipt pursuant to B. VIII. no. 8 – at their email address known to ODDSET GmbH.
- If no betting contract has been concluded or if the betting contract has been withdrawn from, the corresponding stakes will be credited to the player account.
- In all other respects, the liability provisions of part E shall apply.
- ODDSET GmbH’s right to proceed with the payment of winnings in accordance with C.III. no. 8 and 9 shall remain unaffected.
IX. Limits, reality check and 24-hour immediate exclusion
- The Customer has the option at any time of setting an individual daily, weekly or monthly deposit, stake or loss limit in their player account. If the Customer wishes to increase the respective limit, the increase shall only become effective upon request and after a protection period of seven days. For the Customer’s protection, ODDSET GmbH reserves the right to refrain from granting the request for a limit increase or to maintain or reduce the original limit without giving reasons. If the respective limit is to be reduced, however, the new limits take effect immediately.
- To ensure player protection, ODDSET GmbH may impose the limits according to B. IX. no. 1 on the Customer (third-party limit) or may adjust them. The Customer will be informed of this.
- Irrespective of the provider-specific limits listed in B. IX. no. 1, the limits imposed by law, in the licence or by the gambling supervisory authority shall apply.
- ODDSET GmbH implements the so-called reality check required by law. Here, Customers are notified of the duration of their activity after 60 minutes have elapsed. The Customer must explicitly confirm the notification before they can continue to participate in the game.
- Customers have the option at any time of excluding themselves from participation in the game for a period of 24 hours. To do this, the Customer must press the button for “Immediate 24h self-exclusion". Once the button has been activated, this cannot be revoked. The game break is transmitted to and entered in the national player exclusion system OASIS. The game break ends automatically after the period of 24 hours have elapsed. - Furthermore, ODDSET GmbH will offer additional options for self-limitation. Reductions become effective immediately, an increase only after a protection period of seven days.

X. Self-exclusion and third-party exclusion
- ODDSET GmbH participates in the legally required national player exclusion system OASIS.
- Customers have the option of excluding themselves from participation in the game at any time with an indefinite exclusion with a minimum duration of three months (self-exclusion). Self-exclusion can be selected in the player account. ODDSET GmbH also has the option of excluding the Customer (third-party exclusion). This third-party exclusion can also be initiated on the basis of information from other third parties. The Customer will be given the opportunity to comment before a third-party exclusion is imposed. Both self-exclusion and third-party exclusion are transmitted to and entered in the national player exclusion system OASIS, regardless of their duration. - The lifting of a third-party exclusion can be applied for after one year at the earliest. The lifting of a self exclusion can be applied for at the earliest after the expiry of the minimum period of three months. The application is to be directed to the authority responsible for the exclusion system (Darmstadt Regional Council, Regierungspräsidium Darmstadt).
- In the cases of B. X. no. 2, the remaining balance on the player account shall be transferred to the customer and the player account shall be blocked.
- In case of a suspicion of problematic gambling behaviour, ODDSET GmbH additionally reserves the right to contact the Customer in this regard.
XI. Monitoring
- ODDSET GmbH monitors and checks its Customers’ transaction and betting behaviour in order to meet its legal obligations.
- In order to safeguard the integrity of sports, ODDSET GmbH reserves the right to report suspicious transactions to the relevant institutions and authorities.
C. Payment transactions via the player account
I. Deposits, payment of stakes and withdrawals
- Deposits to and withdrawals from the player account set up during registration as provided for in B. II. may only be made from or to a payment account within the meaning of section 1 (17) of the Payment Services Supervision Act (Zahlungsdiensteaufsichtsgesetz, ZAG), which has been set up in the Customer’s name with an obligated party within the meaning of section 2 (1) no. 1 or 3 of the Money Laundering Act (Geldwäschegesetz, GwG). Available payment methods are, for instance, bank transfer, PayPal, credit card. The available payment options can be found in the internet offers.
- ODDSET GmbH reserves the right to process payments via service providers, to offer additional payment methods and to refuse payment methods for Customers at any time without giving reasons. For information on the service providers, please see the ODDSET GmbH Privacy Policy.
- Before a deposit requested by the Customer is carried out, a cross-check is made against the LUGAS limit file. For more information on LUGAS, please see the ODDSET GmbH Privacy Policy.
- Participation in a bet is only possible if the player account has sufficient funds (credit balance).
- Credit card payments and other payment methods are booked to the player account and made available for the payment of stakes immediately after successful verification, bank transfers are only booked to the player account and made available for the payment of stakes after the funds have been received in the ODDSET GmbH general account.
- All deposits and withdrawals must be made in Euros.
- All deposits and withdrawals can only be made in the name of or to the registered Customer/account holder. If this is not the case, the transaction will be rejected/cancelled and ODDSET GmbH reserves the right to block the player account.
- The Customer confirms that all deposits originate from lawful sources. Should this not be the case, ODDSET GmbH reserves the right to block the player account, to contact the relevant authorities and to refuse payment of funds until the legal situation has been clarified, unless this contradicts the orders imposed by the relevant authority.
- If chargeback fees, cancellation fees or other fees related to a Customer’s player account are incurred, ODDSET GmbH may invoice the Customer for the corresponding amounts incurred and deduct them from the credit balance on the player account.
- ODDSET GmbH also reserves the right to charge a processing fee for transactions. Processing fees will be charged to the Customer in the course of the transaction. If a processing fee is charged, this will be announced on the ODDSET GmbH websites or mobile internet services.
- Should a deposit to the Customer’s player account overlap for technical reasons with an exclusion of the player account initiated by the Customer or by ODDSET GmbH, the Customer will be notified of this circumstance and asked to submit details of an account to which this deposit can be transferred back immediately and in full (less any applicable fees).
- The funds deposited by the Customers and the winnings accrued will be managed in trust on behalf of the Customers by ODDSET GmbH. Amounts from deposits made to ODDSET GmbH and winnings accrued are secured in the event of ODDSET GmbH’s insolvency, as they are managed in protected bank accounts (verrechnungsfreies Konto), separately from other ODDSET GmbH assets.
- No interest is paid on the credit balance in the player account.
- If a Customer does not place a bet with real money (i.e. funds in the player account that are exclusively attributable to deposits made by the Customer, and not to bonuses) for 12 months, the player account will be listed as inactive. During this time, the player account can be reactivated by placing a bet, and deposits and withdrawals can still be made. Should a Customer not place a bet with real money for 18 months, ODDSET GmbH is entitled to block the player account. Furthermore, ODDSET GmbH also reserves the right to close the account in this case.
- If amounts are credited to a Customer’s player account by mistake, the Customer is obligated to inform ODDSET GmbH immediately. All subsequent winnings based directly or indirectly on this mistake are invalid, irrespective of their actual occurrence. If amounts that were credited to a Customer’s player account by mistake are subsequently paid out by the Customer or placed on a bet that is lost, ODDSET GmbH reserves the right to reclaim the amount.
II. Further information on payment methods
- Appropriate procedures with a security key in accordance with the respective state of the art in information technology are offered for payment by credit card. The credit cards accepted by ODDSET GmbH and the applicable security standards are published on the websites of the credit card providers.
- With each deposit, the Customer accepts the internationally recognised regulations and laws for electronic payment transactions. If the transaction is duly executed, revocation or similar actions are therefore excluded.
- A successful payment, and therefore successful participation in a bet, can only take place if the credit card is not blocked.
- ODDSET GmbH reserves the right to review the Customer's deposits in order to prevent credit card fraud.
- The player account also allows payment by bank transfer. In the case of bank transfers to the player account, the reference number provided by ODDSET GmbH must be stated in the purpose of payment.
III. Withdrawals from the player account
- If the Customer has a fully verified player account, they are entitled to have their credit balance or parts of their credit balance paid out at any time via one of the permitted payment methods, provided that no pay-out ban applies (such as prior to personal identification), that all deposits have been confirmed, and that all deposited amounts have been wagered at least once. ODDSET GmbH also reserves the right to withhold pay-outs until final verification of the payment information.
- ODDSET GmbH reserves the right to refuse or limit pay-outs via certain payment methods, insofar as this is required by law or due to requirements imposed by the payment service providers involved. In particular, ODDSET GmbH is entitled to refuse pay-outs via certain payment methods if the desired method of payment differs from the method used to deposit the funds, or if the deposit method does not have the option of a return transfer, as well as in cases of reasonable doubt about the Customer’s identity. In these cases, pay-outs can be made to a bank account that is registered in the Customer’s name and identifies the Customer as the account holder.
- A pay-out may be deferred if this is necessary, for instance, for security reasons or to comply with legal requirements. This is the case, in particular, if
a) internal processes to ensure compliance with legal requirements make this necessary; or b) ODDSET-GmbH has a legitimate interest in a further clarification of the facts. - Until the applicable bonus conditions have been met in full, any free betting credits and marketing bonuses granted by ODDSET GmbH may only be used for betting, and can therefore not be paid out (wagering obligation).
- The Customer has the option of specifying in the player account that winnings above a certain amount are automatically paid out to them.
- ODDSET GmbH reserves the right to deviate from the payment method requested by the Customer in individual cases (for instance by charging back to the credit card used). In particular, pay-outs of winnings of amounts above EUR 15,000 are usually only made by bank transfer.
- ODDSET GmbH reserves the right to combine several individual withdrawal transactions requested within 48 hours, and to transfer them in one amount and to one bank account/PayPal account/credit card etc.
- ODDSET GmbH is not responsible for withdrawals made from the player account by unauthorised third parties despite appropriate protective measures taken by ODDSET GmbH.
D. Determination and crediting of winnings
I. Determination and valuation of betting events
- The determination and valuation of betting events is primarily governed by the Betting Rules. Unless stipulated otherwise in the Betting Rules, the determination and valuation will be based on the official results of the first sporting instance. If an overall result relevant for the valuation of a bet can be determined from official results that have already been published, the valuation will already be determined at this point in time, even if the sporting event has not yet ended. The valuation of the bets placed is displayed in the "My bets" section.
- When using ODDSET sports betting, the General Betting Rules and the associated Special Rules apply.
Unless stated otherwise, all times and dates published by ODDSET GmbH in the internet offers are the scheduled start times (“Start Date") in Central European Time (CET/CEST).
- In the case of live betting, if a bet is placed with an incorrect amount due to delayed TV coverage or data transmission after the selected participant/team has gained a decisive advantage, we reserve the right to declare the bet void, regardless of whether it would have won or lost.
- If a bet is declared “void” or “invalid” (for instance if the betting event is cancelled), this bet is valued as “won” at odds of 1.00. For single bets, the stakes are refunded. In the case of combined bets where cancelled events are displayed together with other valid events with a win forecast, the cumulative odds will be adjusted accordingly.
- If the bet is placed – for whatever reason – after the start of the betting event, the bet is void (this does not apply to live bets). The bet is valued as “won” at odds of 1.00. In the case of “live bets”, any bet received by ODDSET GmbH after the occurrence of its result is invalid and will be valued as “won” at odds of 1.00.
- Winnings are determined in accordance with the principles set out in these T&C and, in particular, in the Betting Rules, which serve for the determination and valuation of the betting results.
- The valuation is based on the results of the betting events selected by the Customer.
II. Fee, determination of winnings, probabilities of winning
- ODDSET GmbH charges a fee of 5% ("5% fee") of the gross winnings (stake multiplied by the odds) for each winning bet. The net winnings that are decisive for the pay-out are calculated by deducting the fee from the gross winnings. The fee and gross/net winnings are displayed to the Customer in the bet slip after selecting the bet and the stakes.
- This fee is charged to Customers who have their domicile or habitual residence in the Federal Republic of Germany at the time the betting contract is concluded. This does not apply if the Customer is located outside the Federal Republic of Germany when the betting contract is concluded. ODDSET GmbH is entitled to determine the Customer’s actual location at the time of placing the bet by means of geolocation for the purpose of determining the collection of fees, to store this information for the purpose of calculating the tax and for verification by the tax authorities, and to forward this information to the latter if a corresponding legal obligation applies.
- In the case of live betting, the Customer may accept any changes in odds during the placing of the bet. Changes in odds are those changes that occur in the period between the entry of the tip in the bet slip and the confirmation of the bet by ODDSET GmbH. The actual odds will be displayed in the betting confirmation. If the Customer does not receive a betting confirmation, the bet is nevertheless valid if it appears in the “My bets” section of their account.
- For single bets, the (theoretical) probability of winning corresponds to the ratio of 1:number of prediction possibilities provided. This (theoretical) probability of winning is subject to the condition that the occurrence of each of the prediction possibilities provided has the same probability.
- For combination bets, the probability of winning depends on the number of betting events combined and the type of bet selected (regular or system bet). The (theoretical) probability of winning decreases with each additionally selected betting event. The following values of the (theoretical) probability of winning for combined bets are subject to the condition that the occurrence of each outcome of a betting event has the same probability. For combination bets, the (theoretical) probability of winning is shown in the following table:

- Regardless of the potential pay-out of winnings and the theoretical probability of winning, there is a risk of losing the stakes completely every time a bet is placed.
- ODDSET GmbH determines fixed odds in advance for each prediction option it offers on the outcome of a betting event. These are given with an accuracy of two decimal places. The total odds of a combination bet are calculated by multiplying the individual odds of all tips included in the respective combination bet. This is be done taking into account the odds set at one (1.00) in accordance with these T&C. ODDSET GmbH reserves the right to set different odds for selected bets.
- A system bet is made up of multiple bets. The winnings are therefore calculated from the sum of the winning amounts of the correctly forecast bets.
- The total pay-out amount per betting order is rounded down by the sports betting system to four decimal places after the decimal point. For technical reasons, the account balance in the player account can only be displayed with two decimal places. This may temporarily lead to deviations when a value with four decimal places is rounded down to a value with two decimal places.
III. Crediting of winnings
- Winnings are credited to the player account without undue delay after the winnings have been determined. The credit to the player account is made with debt-discharging effect, unless there are bonus conditions that prevent a possible pay-out.
- Any winnings credited that arise from an error on the part of ODDSET GmbH may be retained or reversed.
- If a betting order comprises multiple betting events, the winnings will be credited after the scheduled completion of the last betting event of the betting order.
E. Liability
- In the event of a breach of obligations that are not directly related to typical betting risks, ODDSET GmbH shall be liable to the Customer both for its own culpable actions and for the culpable actions of its legal representatives or vicarious agents, insofar as the breach concerns obligations the fulfilment of which is a prerequisite for the proper performance of the contract and on compliance with which the contracting partner is regularly entitled to rely (material obligations).
- If the breached obligations are not material obligations, ODDSET GmbH shall only be liable for intent and gross negligence.
- The limitations of liability in part E. nos. 1 and 2 do not apply to losses that fall within the scope of protection of a warranty or guarantee given by ODDSET GmbH, nor to liability for claims based on the Product Liability Act (Produkthaftungsgesetz, ProdHaftG) and losses arising from injury to life, limb or health.
- ODDSET GmbH shall not be liable if technical equipment used by ODDSET GmbH or its legal representatives or vicarious agents to process data (for instance to transfer and store data) malfunctions or fails, without any fault on their part.
- Likewise, any liability for losses caused by criminal acts committed by third parties is excluded.
- Furthermore, ODDSET GmbH shall not be liable for losses caused by force majeure, in particular, but not limited to, losses caused by fire, flooding, strikes, civil unrest or other reasons for which ODDSET GmbH is not responsible.
- In cases where liability of ODDSET GmbH and its vicarious agents has been excluded in accordance with part E. no. 1-6, the stakes will be refunded upon request.
- Third-party agreements are not binding for ODDSET GmbH.
- The liability rules also apply to cases in which liability has already arisen prior to the conclusion of the contract.
- ODDSET GmbH’s liability is limited to compensation of the losses that are typical for this type of contract and that was foreseeable at the time of the conclusion of the contract.
- Due to maintenance work, the ODDSET GmbH internet offers may not always available to the Customer. Any claim for damages in this context is excluded.
- In view of the current state of the art, data communication via the internet cannot be guaranteed to be error-free and/or available at all times. In this respect, liability for the non-availability of the ODDSET GmbH internet offers is excluded.
- Furthermore, ODDSET GmbH assumes no liability for the accuracy, completeness and currentness of the content of information services such as result notifications via email and text message as well as other content. Likewise, information in live scores, statistics and information on intermediate results in live betting is provided without warranty.
F. Data protection
I. Data protection rules
- ODDSET GmbH complies with applicable data protection laws.
- The collection, processing and use of certain data in the context of the creation of an account and the participation in bets is based, inter alia, on legal and contractual grounds. For details, please see the ODDSET GmbH Privacy Policy. This Policy shall be acknowledged at the latest at the time when the Customer registers for an online account.
- The Privacy Policy is also available in the internet offers.
II. Change of Customer data, sending of declarations
- The Customer shall immediately make notification of any changes in personal data and addresses. The same applies to changes in data concerning bank accounts (including bank account closures), permitted and used payment methods (for instance the blocking of a credit card) and email addresses – provided that ODDSET GmbH has collected such data from the Customer. ODDSET GmbH reserves the right to verify the changed data.
- Any written declarations that ODDSET GmbH sends to the Customer’s last address known to ODDSET GmbH shall be deemed to have been received by the Customer three days after posting. Exception: The declaration is of particular importance.
If personal data is updated, the Customer will have to once more complete the identification process described in B. II. no. 4.
G. Final Provisions
I. Assertion and limitation of claims
- The statutory provisions shall apply to the assertion and limitation of claims.
- Complaints are to be addressed by the Customer in text form to customer service. ODDSET GmbH will duly examine the complaint and endeavour to process it within two weeks and inform the Customer of how the complaint has been dealt with.
- ODDSET GmbH is entitled to waive rights under these T&C in individual cases. The Customer cannot derive from this any claim to a comparable waiver of rights in the future.
II. Customer’s duties of care
- Access data must be kept secret by the Customer. The Customer can change the password at any time and should make regular use of this possibility.
- Any dispositions made by unauthorised third parties because they have knowledge of the login data shall be to the detriment of the registered Customer.
- Users/Customers are also responsible for informing themselves about the relevant laws.
III. Online dispute resolution
The European Commission's online dispute resolution platform for consumers (ODR) is available at http://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in a dispute resolution procedure before a consumer arbitration board.
IV. Additional provisions
- By registering, the Customer acknowledges the exclusive intellectual property rights of ODDSET GmbH and its (technical) service providers to the internet offers and the associated services.
- The ODDSET GmbH internet offers are protected by copyright in all content-related and factual parts. They must not be taken over, used or exploited, whether entirely or in part.
- If ODDSET GmbH offers translations of these T&C in languages other than German, the German version of these T&C shall take precedence in the event of incorrect translations.
- The Customer is not permitted to assign, pledge or otherwise legally dispose of any claims they may have against ODDSET GmbH, whether against payment or free of charge.
- If any of the above provisions are invalid in whole or in part, the contract concluded between the Customer and ODDSET GmbH as well as any betting contract concluded by the Customer with ODDSET GmbH shall remain valid. Insofar as individual provisions are invalid, the content replacing such provisions shall be based on the legally permissible provisions that come as close as possible to the invalid provisions.
